Privacy Policy

Last updated: 5 November 2026

1. Who we are

This policy explains how EKOH Marketing Pty Ltd (ABN 69 648 883 014), trading as EKOH Marketing and EKOH Systems (“EKOH”, “we”, “us”), handles personal information. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

2. What we collect

  • Contact and business details: your name, email, phone number, role, company name and website, from enquiries, our application form, call bookings and correspondence.
  • Application information: what you tell us about your business, such as revenue range, advertising spend, ecommerce platform and goals.
  • Business contact information from public and third-party sources: names, roles and business contact details of people at businesses we may work with. We collect these from company websites, professional networks and business data providers.
  • Client engagement information: details of the people we deal with at our clients, call notes and recordings (with notice), and the records needed to deliver our services and invoice for them.
  • Technical information: when you visit this website, our hosting provider automatically records standard information such as IP address, browser type and the pages requested, for security and operations.

We do not ask for sensitive information (such as health information, religious beliefs or political opinions) and ask that you do not provide it. If you choose to share it, we will only use it for the purpose you provided it for.

3. Cookies and embedded services

This website does not set its own advertising or analytics cookies. Our application form (Tally) and booking calendar (Google) are embedded third-party services and may set their own cookies under their own privacy policies. If we add analytics or advertising tools, we will update this policy first.

4. Why we collect and use it

  • to respond to your enquiry or application and assess whether we are a good fit;
  • to prepare for and hold strategy calls, including preparing a review of your public website;
  • to provide, manage and invoice our services;
  • to send you information about our services that is relevant to your business role (see section 5);
  • to improve our services and run our business; and
  • to meet our legal obligations.

5. Direct marketing

We may contact business decision-makers about services relevant to their role. We do this in line with the Spam Act 2003 (Cth): every commercial email identifies us and has a working way to unsubscribe. You can opt out at any time by using the unsubscribe link or emailing us, and we will act on your request within five business days. We do not sell personal information.

6. Who we share it with

We share personal information only with people who help us run our business, including:

  • website hosting (Vercel);
  • forms and scheduling (Tally, Google);
  • email, document, CRM, call recording and productivity tools;
  • AI and automation tools we use to help research, draft and organise our work; and
  • professional advisers such as accountants and lawyers, or where the law requires it.

Our providers are only permitted to use the information to provide their services to us. Several are based outside Australia or store data overseas, mainly in the United States and the European Union, so your information may be disclosed or stored there. We take reasonable steps to make sure those providers protect it.

7. AI and automated processing

We use AI tools, including AI models provided by third parties, to help research businesses, draft content and organise our work, and we build AI agents for our clients. A person reviews our own AI-assisted work. We do not use computer programs to make decisions about individuals that could significantly affect their rights or interests. If that changes, we will update this policy to explain the kinds of personal information used and the kinds of decisions made. Information you give us is not used to train publicly available AI models.

8. Information we handle for our clients

When we work on a client's website, store, advertising or email accounts, we may have access to personal information about that client's customers. We use it only to deliver services to that client, on their instructions and under our Client Agreement. We never use it for our own purposes or for any other client. If you are a customer of one of our clients, please contact that business about your information.

9. Security and retention

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. These include access controls, multi-factor authentication and limiting access to people who need it. We keep information only for as long as we need it for the purposes above or as the law requires, and then delete or de-identify it.

If a data breach is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.

10. Accessing and correcting your information

You can ask for access to the personal information we hold about you, or ask us to correct it, by emailing us. We will respond within 30 days. If we refuse, we will tell you why and how to complain.

11. Complaints

If you have a privacy concern, please email us first. We will acknowledge your complaint within seven days and aim to resolve it within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.

12. Changes to this policy

We may update this policy from time to time. The current version is always on this page.
