Website Terms of Use

Last updated: 5 November 2026

1. About these terms

This website is operated by EKOH Marketing Pty Ltd (ABN 69 648 883 014), trading as EKOH Marketing and EKOH Systems (“EKOH”, “we”, “us”). By using this website you agree to these terms. If you do not agree, please do not use the website.

These terms govern your use of the website only. Any services we provide are governed by a separate written agreement signed by you and us (a “Client Agreement”). If anything on this website is inconsistent with your Client Agreement, the Client Agreement prevails.

2. Using this website

You may use this website for lawful purposes. You must not:

  • use the website in a way that is unlawful, misleading or infringes anyone else’s rights;
  • interfere with the website’s security or operation, or introduce malicious code;
  • scrape, copy or republish the website’s content for commercial purposes without our written consent; or
  • submit false information or impersonate another person in any form or enquiry.

3. Information only — not an offer or advice

The content on this website is general information about our services. It is not tailored advice for your business, and it is not an offer capable of acceptance. We only take on an engagement after a strategy call and a signed Client Agreement.

Prices shown on this website are indicative starting points. Your price, currency, scope, timing and any GST are confirmed in your proposal and Client Agreement. Where GST applies, it is added to the fees stated unless we say otherwise. Availability (for example, a limited number of new clients per quarter) reflects our capacity at the time and may change.

4. Case studies and results

Case studies and results on this website describe what was achieved for specific clients in their particular circumstances. They are not typical results and are not a promise or prediction of what your business will achieve. Outcomes depend on many factors outside our control, including your products, pricing, offer, traffic quality, advertising spend, market conditions, seasonality and how quickly changes are implemented. Client names are used with permission.

Any target or projection on this website (for example a return-on-investment target) is an aim, not a promise. We make performance commitments only where they are written into a signed Client Agreement.

5. AI agents, automation and AI-generated content

We design, build and run marketing systems, automation and custom AI agents for businesses. If you engage us to do so, your Client Agreement sets out what we build, who owns it, how it is hosted and supported, and how its use is supervised. In general:

  • AI output can be wrong. AI systems can produce inaccurate, incomplete or inappropriate output. Agents and content we build are designed to be used with human oversight. Review output before relying on it or publishing it, especially for legal, financial, health or customer-facing decisions.
  • Third-party AI providers. Our solutions rely on third-party models and platforms (for example Anthropic, OpenAI or Google). Their terms, usage policies, availability and pricing apply and may change. We are not responsible for their outages or changes.
  • Agreed limits. Agents act only within the permissions, tools and approval steps agreed in writing. You are responsible for the instructions you give and for actions you approve.
  • Acceptable use. We will not build, and you must not use our work for, anything unlawful, deceptive or harmful. That includes unsolicited bulk messaging that breaches the Spam Act 2003 (Cth), impersonation, or processing personal information without a lawful basis.
  • Ownership. Australian copyright law may not protect content generated by AI without sufficient human authorship. Ownership of code, prompts, configurations and outputs is set out in your Client Agreement.

6. Intellectual property

The content, design, text, graphics and code on this website are owned by or licensed to EKOH and are protected by copyright and other intellectual property laws. You may view and print pages for your own reference. Any other use requires our written consent. Third-party names and logos belong to their owners.

7. Enquiries, applications and bookings

Our application form is provided by Tally and our booking calendar by Google. When you use them, their terms also apply. We handle the information you submit in line with our Privacy Policy. Submitting an application or booking a call does not create any obligation on you or us to enter into an engagement.

8. Third-party links

This website may link to websites and services we do not control. We are not responsible for their content, availability or privacy practices.

9. Australian Consumer Law and our liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Subject to that, we provide this website as is. We take care to keep it accurate and available, but we do not promise that it will be error-free, current or uninterrupted. To the extent the law allows, we are not liable for any loss arising from your use of, or reliance on, this website. That includes indirect or consequential loss and loss of profit or revenue.

10. Privacy

Our Privacy Policy explains how we collect, use and protect personal information.

11. Changes to these terms

We may update these terms from time to time by publishing a new version on this page. The version in force when you use the website applies. Changes do not affect a Client Agreement already signed.

12. Governing law

These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts that hear appeals from them.
